1. Service Description
Old Masters provides AI-generated portrait services and connects customers with professional oil painting artists. By accessing or using our website (oldmasters.art) and services, you agree to be bound by these Terms of Service.
2. AI Portrait Service ($35)
Payment is charged at checkout. The AI-generated portrait is delivered within 10 minutes by email to the address provided during checkout. If the portrait is not delivered within 30 minutes, please contact us at hello@oldmasters.art for assistance.
Satisfaction Guarantee: If you are unsatisfied with the AI portrait, contact us within 30 days of purchase for a regeneration or a full refund.
3. Oil Painting Assessment ($12)
The $12 assessment fee is non-refundable once a studio advisor has reviewed your project and sent a custom quote. If we fail to deliver a quote within 48 hours of your submission, the fee will be refunded in full. The $12 assessment fee is credited toward your final painting price should you proceed with a commission.
4. Real Oil Painting Commission
Full payment is required before production begins. The production timeline is 3–6 weeks from the date of payment. If the production timeline exceeds the stated estimate by more than 2 weeks without prior notice, the customer may cancel the order for a full refund.
Paintings are custom, hand-made artworks and cannot be returned once shipped unless damaged in transit. In the event of transit damage, you must notify us within 7 days of delivery with photographic evidence.
5. Intellectual Property
AI-generated portraits are licensed to you for personal and commercial use. You retain all rights to your original uploaded photograph. Old Masters retains all rights to the AI model, the generation process, and any underlying technology.
6. Prohibited Uses
You must own or have the necessary rights and consents to the photos you upload. Do not upload photos of others without their explicit consent. Do not use the service for any illegal, fraudulent, or infringing purposes, including but not limited to generating content that is defamatory, obscene, or violates any third-party rights.
7. Limitation of Liability
To the fullest extent permitted by law, Old Masters shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the service. Our maximum aggregate liability to you for any claim arising under these terms shall not exceed the amount you paid for the specific order giving rise to the claim.
8. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflict of law provisions.
